1. Introduction

These Terms & Conditions (“Terms”) govern your use of the SmartWebStart website and services. SmartWebStart is a trading name of LS22 Web Solutions. By using our website or purchasing our services, you agree to be bound by these Terms.

2. Services

SmartWebStart provides:

• CRM and eCommerce website setup for small and medium-sized businesses
• Customer relationship management tools
• Online storefront creation and management
• Lead capture and follow-up automation
• Ongoing hosting and support

The specific deliverables for each client are agreed upon during the discovery call and onboarding process.

3. Pricing & Payment

• The one-time setup fee is £499, payable before work begins
• The monthly subscription is £79/month, billed monthly in advance
• All prices are in GBP and inclusive of VAT where applicable
• Payments are processed securely via Stripe
• The setup fee is non-refundable once work has commenced

4. Delivery & Timescales

We aim to deliver your initial website and CRM setup within 5 working days of receiving all required content and assets from you. Delays caused by late or incomplete content from the client may extend this timeline.

5. Client Responsibilities

You agree to:

• Provide accurate business information, content, and images in a timely manner
• Respond to requests for feedback or approval within a reasonable timeframe
• Ensure all content you provide does not infringe any third-party rights
• Maintain the security of any login credentials we provide

6. Intellectual Property

Upon full payment, you own the content you provide and the customised elements of your website. SmartWebStart retains ownership of the underlying platform, templates, code, and systems used to deliver the service.

7. Hosting & Availability

We provide hosting as part of the monthly subscription. While we aim for high availability, we do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible.

8. Cancellation

• You may cancel the monthly subscription at any time with 30 days' written notice
• No refund will be provided for the current billing period upon cancellation
• We will provide a reasonable period to export your data upon cancellation
• The setup fee is non-refundable once work has begun

9. Limitation of Liability

To the maximum extent permitted by law, SmartWebStart shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid by you in the 12 months preceding any claim.

10. Data Protection

We process personal data in accordance with our Privacy Policy and applicable UK data protection legislation, including UK GDPR.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the English courts.

12. Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated to active subscribers. Continued use of our services following any changes constitutes acceptance of the revised Terms.
